Terms of service

1. About us

These Terms of Service ("Terms") govern the relationship between The Iberian, a sole proprietorship (eenmanszaak) established under the laws of the Netherlands, with registered address at Androsdreef 90, 3562 XC Utrecht, the Netherlands, registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under number 95732993 and VAT number NL005171306B83 (hereinafter "The Iberian", "we", "our"), and the customer placing an order through our website (hereinafter "you", "the customer"). 2. Scope

These Terms apply to every visit to and every purchase made through theiberian.nl and theiberian.store (the "Website"). By placing an order or creating an account you confirm that you have read, understood and accepted these Terms. These Terms are available at all times on our Website and are intended for consumer (B2C) sales. For wholesale, press or partnership enquiries, please contact us by email; separate terms may apply.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to place an order on our Website. By placing an order you confirm that you meet this requirement.

4. Products and pricing

We make every effort to describe and photograph our products accurately, but slight variations in appearance, weight, colour or curing may occur, as our products are natural and handmade by traditional methods. Prices are shown in euro (€) and include applicable VAT for deliveries within the European Union, unless stated otherwise. Shipping costs are displayed at checkout.

5. Orders and acceptance

An order is only confirmed when you receive an order confirmation email from us. Prior to that confirmation, no contract is formed. We reserve the right to cancel or refuse any order at our sole discretion in cases of pricing errors, product unavailability, suspected fraud, or inability to fulfil the order. In such cases, a full refund will be issued and you will be notified promptly by email.

6. Payment

Payment is due in full at the time of order through the payment methods offered at checkout. All payments are processed through secure third-party providers. We never store your full payment card details on our servers.

7. Shipping and delivery

Shipping terms, delivery times, costs and responsibilities for customs duties are set out in our separate Shipping Policy, which forms an integral part of these Terms.

8. Right of withdrawal (14 days) and legal exceptions

Under EU consumer law, you have the right to withdraw from your purchase within 14 calendar days of receiving the goods, without giving any reason.

However, in accordance with Article 16 of Directive 2011/83/EU, the right of withdrawal does not apply to:

  • Perishable goods or goods with a short shelf life;
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and have been unsealed after delivery;
  • Goods which, after delivery, have been inseparably mixed with other items.

As most of our products fall within these categories, the right of withdrawal generally does not apply. For non-perishable, sealed items that have not been opened, you may exercise your withdrawal right within 14 days of receipt by contacting us at contact@theiberian.store. The returned items must be in their original condition and packaging. Return shipping costs are borne by the customer, and a refund will be issued within 14 days of receiving and inspecting the returned goods.

9. Legal guarantee

All our products benefit from the legal guarantee of conformity under Dutch and EU consumer law. If a product arrives damaged, defective or does not match the description, please contact us within 7 days of delivery at contact@theiberian.store with photographs of the product and packaging, and we will resolve the issue promptly by replacement, exchange or refund.

10. Use of the Website

You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of others. In particular, you agree not to:

  • Use automated systems, scrapers, bots, spiders or any similar technology to extract data from the Website;
  • Copy, reproducredistribute, sell or commercially exploit any content of the Website without our prior written consent;
  • Attempt to gain unauthorised access to the Website, its servers or any connected systems;
  • Upload, transmit or distribute any malicious code, viruses or harmful material;
  • Interfere with the normal operation of the Website, including by sending spam, excessive traffic or abusive requests;
  • Register an account using false, misleading or third-party information.

11. Intellectual property

All content on the ebsite, including without limitation texts, photographs, videos, graphics, logos, product descriptions and the overall design, is the exclusive property of The Iberian or its licensors and is protected by applicable intellectual property laws. "The Iberian"™ is a trademark used in commerce by The Ibeian; all rights are reserved.

Nothing in these Terms grants you any licence or right to use any of our content, trademarks or trade dress beyond the personal browsing and purchasing of products on the Website.

12. User-generated content (reviews and comments)

If you submt reviews, comments, photographs or any other content to the Website, you grant The Iberian a non-exclusive, worldwide, royalty-free, perpetual and transferable licence to use, reproduce, translate, display and adapt such content for commercial, marketing and editorial purposes, including on our Website, social media and advertising. You warrant that any content you submit is your own and does not infringe the rights of third parties.

13. External links

Our Website may contain links to third-party websites. We are not responsible for the content, accuracy or practices of any third-party website and inclusion of any link does not imply endorsement.

14. Limitation of liability

To the fullest extent permitted by law, The Iberian shall not be liable for indirect, incidental, consequential or special damages arising out of the use or inability to use the Website or the products, except in cases of intent or gross negligence. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under Dutch or EU law.

15. Force majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to strikes, carrier disruptions, natural disasters, epidemics, war, governmental actions or supplier shortages.

16. Privacy

Peral data collected through the Website is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.

17. Changes to these Terms

We may update these Terms from time to time to reflect changes in our business or in applicable law. The version in force at the time of your order is the version that applies to that order. The latest ion is always available on our Website.

18. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms or your use of the Website shall be submitted to the competent courts of the Netherlands, without prejudice to the mandatory consumer protection rights that you may enjoy under the law of your country of residence within the European Union.
